I can't imagine it, but let's say a Muslim student did this way back, and nothing happened, and then a Jewish kid did the same thing, and again no response. And then here comes the Christian, and they give him a 5-day suspension. In that case, the school would definitely have an establishment clause problem. They might also have an equal protection problem, though that might be a stretch. The kid might also have a sort of inverted free exercise claim, but again, I think the school could defeat that.
